What sorts of cases can public liability claims be?
The most common claims we see are slips and falls in public areas, such as supermarkets, shopping centres, or footpaths. But public liability claims extend to many different circumstances that aren’t caught by WorkCover or TAC laws.
What can be claimed?
There are two main things that can be claimed in a public liability matter. The first is ‘economic loss’ – like loss of wages, medical and related expenses.
The second is pain and suffering, but there is for most claims a restriction on who can bring a pain and suffering claim. This restriction requires an injury from the negligent act to be permanent and meet certain other criteria.
