Below are some questions that the TAC recommends you ask when you are deciding on picking a lawyer for your TAC claim, and what to ask them. To save you some work, we’ve gone ahead and answered them for you.

Things to ask when picking a lawyer

What experience do you have in transport accident claims?

We’ve been running TAC claims for over 36 years. This includes everything from helping someone have their initial claim accepted, assisting with getting their pay rate from the TAC right, disputes about what medical treatment the TAC will pay for, impairment benefit claims and serious injury/common law claims.

We have run cases in the County Court, Supreme Court, Court of Appeal and VCAT.

Do you participate in the Common Law Protocols?

Yes we participate in the TAC Common Law Protocols.

Do you provide a free initial appointment? What conditions (if any) are attached to this appointment?

Yes, we provide a free initial appointment so you can meet us and get some advice in relation to your claim. There are no conditions attached to this. If you decide not to use us, there is no bill or other obligation.

Can we meet somewhere convenient for me? (For example, at home)

Yes, for most clients, if needed we can arrange to meet you at a suitable place. Many legal appointments can be done over the telephone or by videocalls.

Things to ask in the appointment

What are my potential entitlements?

We will answer this for you in detail during your initial appointment with us, with advice tailored to your situation. Unlike some other Victorian personal injury firms, we will help you with all of your entitlements rather than just a common law claim.

What is the legal process to access my entitlements?

The process is governed by what the law says, as well as the TAC protocols which apply to no fault dispute resolution, impairment claims and common law protocols. We’ll explain all of this to you during your appointment.

Sometimes Court is necessary, but often claims can be resolved without the need to go to Court.

What is the likelihood that my claim will be successful?

This is of course mostly going to depend on the circumstances of your accident and the severity of your injuries. We will give you tailored advice on this during your appointment.

Do I have any other potential legal rights or claims?

You may have other entitlements, like total and permanent disablement insurance through your superannuation fund. We will advise you on all potential claims you might have when we meet with you.

Do you have a ‘No win, no fee’ policy? What does this mean and how are fees calculated? Will I still be out of pocket?

Yes, nearly all of our injury claims are run on a true, No Win, No Fee basis. Read more about that here. We believe our no win no fee offering is more favourable than those offered by many other firms in Victoria

What legal fees will I have to pay?

If your claim is successful, you’ll pay for legal costs and expenses that can’t be recovered from the TAC. We discuss this with you in greater detail during your appointment with us.

Will I have to pay any costs before my claim is settled?

No. You only pay our costs after your claim has been settled and the compensation has been paid by the TAC.
