What is TPD and IP?

‘TPD’ is total and permanent disability insurance. ‘IP’ is income protection insurance. Most commonly, these insurance types are held in your superannuation fund, often without you having to have signed up for them, at least in the case of TPD insurance. Sometimes people take out their own TPD or IP insurance through an insurance company.

While you wont be able to claim IP at the same time as receiving weekly payments from WorkCover or TAC, you are able to claim TPD at any time.

Claiming TPD insurance also doesn’t require the disablement to be caused by a work or road accident, it could be from a health condition or accident at home etc.

Do I need a lawyer for a TPD or IP claim?

Many superannuation funds tell you that you don’t need a lawyer to pursue a TPD claim. In really straightforward TPD claims, that might be the case. Otherwise, you should at least explore the option of having legal representation.

What legal fees will I have to pay?

If your claim is successful, you’ll pay for legal costs and expenses relating to the claim. We will talk to you in greater detail during your appointment with us.

We have spoken to many people who have had other lawyers act on their behalf in relation to a TPD claim. There can be very significant variations in the costs charged, and from what we have seen, we charge much less than most firms.

In a straightforward TPD application that’s likely to be accepted, we believe that your costs should modest. We have seen matters where people have been charged more than six times what we would have charged for straightforward TPD claims that have been lodged with the superannuation fund and then were then accepted.

Will I have to pay any costs before my claim is settled?

If you are approved for a ‘no win, no fee’ arrangement you are, in the ordinary course of events, only required to pay our costs after your application has been approved.
